The agency's commission — reassigned to the landlord by the 2023 housing law, and still appearing on tenants' invoices.
Spain's housing law moved the agency's commission for finding a tenant and formalising a residential lease onto the landlord. A tenant being asked to pay it is being asked for something the law reassigned.
The charge did not vanish; it was renamed. It reappears as an administrative fee, a contract-formalisation charge, a tenancy-management cost. The ban is on the commission itself, not on the heading above it, so the useful question at the counter is not whether it is legal but what service is being billed to you as tenant.
A genuinely separate service you chose — an inventory report you asked for, say — is a different matter. The test is whether you selected it.
What to check in the contract
Ask for the invoice itemised by concept, in writing. It is a reasonable request, and it is hard to answer when the honest answer is the commission.
